As we noted recently, Chief Judge Stark has a practice of holding "§ 101 days," in which he hears oral argument on a number of § 101 motions all at once, each from a different case. He typically issues decisions from the bench regarding each motion—which is always exciting—and follows up later with a written decision.
At first it seemed that § 101 days tended to be fatal for the patents involved, but more recent hearings have shown otherwise.
On Friday, Chief Judge Stark posted the schedule and public access information for his next § 101 day, set for Friday, March 12, 2021:
ORAL ORDER: IT IS HEREBY ORDERED that at the March 12, 2021 "101 Day" motions hearing teleconference beginning at 10:00 a.m., the Content Square case (C.A. No. 20-832) will be argued first and each side will have 30 minutes for its argument; the Moxchange cases (C.A. Nos. 20-1123 & 20-1440) will be argued second and each side will have 20 minutes for its argument (that is, both defendants will share 20 minutes for argument); and the Blix case (C.A. No. 19-1869) will be argued third and each side will have 20 minutes for argument. . . . The parties and any interested member of the public can access the teleconference by dialing 877-336-1829 and using the access code 1408971. ORDERED by Judge Leonard P. Stark on 3/5/21. So, if you were thinking "boy it would be nice to spend a few hours attending a combined telephonic § 101 motion hearing this Friday," this is your chance!
